General Terms and Conditions of Use of the Fit Net Website and App

These General Terms and Conditions ("Agreement") govern access to, registration on, and use of the FIT NET website ("Website") and mobile application ("App"), as well as any information, resources, and content services made available through them, including newsletters, download areas, blogs, and forums (collectively, the "Services"). By accessing or using the Website at www.fitnet.pt and/or downloading, installing, registering for, or using the App, the User confirms that they have read, understood, and fully accepted this Agreement. If you do not agree, you must refrain from using the Website and/or the App.

1. Service Provider

The Services are provided by:

JUMATIC, S.A. ("Company"), with registered office at Edifício The Tower, Rua do Silval, 37, Sala 1.4, 2780-373 Oeiras, Portugal, registered under company number 518082229, being the entity responsible for the management of the FIT NET gym network.

2. Purpose and Scope

This Agreement sets out the terms and conditions governing the use of the Website and the App, including all features, content, services, and functionalities provided either directly by FIT NET or by third parties via the Website or App.

3. Definitions

• Website: The official FIT NET website hosted at www.fitnet.pt
• App: The official FIT NET mobile application
• Service(s): All features, content, services, and functionalities accessible via the Website and/or App
• User: Any individual accessing and using the Website and/or App
• FIT NET Account: The User's digital account used to access FIT NET services
• Third Parties: External entities providing services, content, or functionalities integrated into the Website or App

4. Acceptance

Registration, authentication, or use of the Website and/or App constitutes full and binding acceptance of this Agreement. By registering, the User confirms they have the legal capacity to do so.

5. Access, Registration and Security

5.1 Full access to Website and App functionalities requires the creation of a FIT NET Account.

5.2 The User is solely responsible for ensuring that all registration data is accurate, complete, and up to date.

5.3 Login credentials (e.g. username and password) are personal and non-transferable. The User is fully responsible for maintaining their confidentiality and for all activity carried out under their account, and must notify FIT NET immediately of any unauthorised use.

6. Third-Party Services and Content

6.1 The Website and App allow Users to access information, manage services, and carry out operations related to FIT NET services.

6.2 The Website and App may include or facilitate access to third-party services, content, or external websites.

6.3 Such services are independently provided and managed by those third parties. FIT NET does not control, endorse, guarantee, or assume responsibility for their availability, accuracy, legality, security, or content.

6.4 Use of third-party services is subject to their own terms and privacy policies, which the User must review and accept.

7. Operation of the Website and App

7.1 The Website and App are provided "as is". FIT NET does not guarantee uninterrupted availability, continuity, reliability, or security.

7.2 If the Website or App ceases to function properly, the User should check for updates or new versions and install them where applicable.

7.3 In the event of malfunction, the User should contact FIT NET via cliente@fitnet.pt.

7.4 FIT NET will use reasonable efforts to resolve issues but does not guarantee resolution.

7.5 The User is responsible for taking appropriate measures to protect their own equipment and systems.

8. Management and Modification of Services

8.1 FIT NET reserves the right, at any time and without prior notice, to modify, suspend, or discontinue any content, features, or Services, including their presentation and functionality.

8.2 FIT NET may suspend, restrict, or terminate access to the Services in whole or in part, including where necessary to:

• Ensure system security, integrity, or quality
• Address suspected fraudulent, abusive, or unlawful use
• Comply with legal or regulatory obligations
• Respond to decisions by competent authorities
• Protect system performance or other users

9. Conditions of Use

9.1 The User agrees to use the Website and App lawfully, responsibly, and in accordance with this Agreement.

9.2 The following are strictly prohibited:

• Use for unlawful, fraudulent, or harmful purposes
• Actions that damage or disrupt systems or services
• Uploading or spreading malware or harmful code
• Unauthorised access to restricted systems or data
• Infringement of intellectual property rights
• Any use outside the intended purpose of the Website or App

10. Advertising

FIT NET may display advertising, promotional materials, and service-related information on the Website and/or App.

11. Intellectual Property

All content, including text, graphics, software, trademarks, and logos, is the property of FIT NET or third parties and is legally protected. Use of the Website or App does not grant any ownership rights to Users.

12. Liability

12.1 Information provided is for general informational purposes only and is not guaranteed to be fully accurate or up to date.

12.2 FIT NET shall not be liable for any direct or indirect damages arising from:

• Use or inability to use the Website or App
• Unauthorised access to User data
• Third-party actions or content
• Technical failures or interruptions

12.3 FIT NET shall not be responsible for damages resulting from:

• User device issues or incompatibility
• Technical faults, interruptions, or malware
• Network or connectivity failures
• Cyberattacks or unauthorised access
• User-side security failures
• Force majeure events
• Service modifications or interruptions

12.4 Where liability is legally established, it shall be limited to the amount paid by the User for the relevant service.

13. Costs

Access to the Website and basic use of the App are free of charge. Additional costs may apply to:

• Internet or mobile network usage
• Paid services
• Third-party services

14. Data Protection

Personal data is processed in accordance with the GDPR and FIT NET's Privacy Policy, available at www.fitnet.pt. Users may exercise their rights (access, rectification, erasure, etc.) by contacting: dados.pessoais@fitnetgyms.com

15. Suspension and Termination

FIT NET reserves the right to suspend or terminate User access without notice where there is breach, misuse, or unlawful use of the Services.

16. Governing Law and Jurisdiction

This Agreement is governed by Portuguese law. Any disputes shall be subject to the jurisdiction of the courts of Lisbon, unless otherwise required by mandatory law.

17. Final Provisions

• Users should retain a copy of this Agreement for future reference
• Invalid provisions do not affect the remainder
• FIT NET may update these Terms at any time
• Continued use constitutes acceptance of updated Terms
